the rules change every day, intitally it used to be very tought to get a waiver, these days it is possible, but do not forget if you don't you go back to your home country for two years, also J1 is an exchange visitor visa- so has more rejection potential at the embassy that H1, which by definition is of dual intention- you can apply for immigration so you do not have to explain why will you not stay in the country once you are done.
J1 process is very tedious -you have to get statemenet of need every year from your home country.
So if you get H1 grab it- if you get J1 think about it.
